Bentuk Kemaslahatan Ijtihad Majelis Ulama Indonesia Tentang Hukum Merokok Berdasarkan Fatwa Ke III Tahun 2009

Abstract

That in this study researchers judged that based on the fatwa of the Indonesian Ulema Council smoking is prohibited with the intention to avoid various diseases and benefits for many people. As a religion that gives mercy to fellow Muslims are also very strong; likan the survival of many people. It brings mercy and compassion to every human being. Islam is a religion that preserves human reason, soul, treasure and honor. Nothing destroys human reason, soul, treasure and honor but Islam has banned it. Islam organizes all aspects of human life for prosperity on earth in order to lead to the happiness of the world and the hereafter. The law of smoking is questionable because there are people who already feel accustomed to their habits. The existence of smokers who voiced to the public after the demands of some community groups who asked for clarity on smoking laws. People feel confused because some forbid, some ask for limited prohibition, and some ask to remain on the status of makruh. The existence of tobacco goods is very helpful in the country's economy, so from the observation of the author that people who smoke more regulated activities do not have a bad impact or dangerous diseases for those who do not smoke (fasif). It is known that currently very many consume cigarettes but endanger others such as pregnant women, young children so the rules need to be strengthened again. Fatwa bans cigarettes are very considered by the community is less effective and needs to be reviewed with various considerations, especially the impact on economic, social and health aspects.
